He also testified that a former laboratory manager at StemExpress told him the company was paid $17,000 for stem cells harvested from the liver of a 19-week-old aborted baby.

Daleiden and Sandra Merritt of the Center for Medical Progress are charged with more than a dozen felony counts of illegal taping in connection with undercover CMP videos released in 2014 that exposed Planned Parenthood trafficking in aborted baby body parts. They face 10 years in jail if convicted.Daleiden and Merritt are claiming a Section 633.5 defense, which exculpates the covert taping of confidential communications when investigating violent crimes. The defense is also arguing Section 632 does not consider as confidential a conversation that can reasonably be expected to be overheard.

Daleiden testified that as well as talking to Holly O’Donnell, a former fetal tissue procurement technician at StemExpress, he also talked to Kristi Rebolcaba, former laboratory manager at StemExpress, and Kristin Liu, a former fetal tissue procurement technician with StemExpress.

He said he talked with Liu on the phone in January 2014 about StemExpress supplying human fetal hearts for a 2012 Stanford University study that used a Langendorff apparatus, which, he said, he had been told by experts required a live beating heart.

Liu told him that StemExpress technicians “had to get beating hearts” and that StemExpress worked with Planned Parenthood Mar Monte abortionists “to change the amount of [cervical] dilation [during the abortion] to get beating hearts from the fetus,” Daleiden testified.

Liu told him that this took place between 2011 and 2012, he said.

Judge Christopher C. Hite frequently overruled numerous objections of deputy Attorney General Johnette Jauron that Daleiden’s testimony was hearsay, ruling that  Daleiden’s testimony was evidence of his “state of mind” — that he believed he was collecting evidence of violent crimes.

Daleiden testified that in 2012, Dr. Ronald Berman was the medical director of both Planned Parenthood Mar Monte and medical director of StemExpress.

Daleiden said former Rebolcaba told him that Berman was in charge of the fetal tissue donation program at StemExpress and that StemExpress was operating under his medical license.

Rebolcaba told him that when she worked there, StemExpress procured “one of the biggest fetal livers” she had seen from Planned Parenthood Sacramento (one of Planned Parenthood Mar Monte’s 30 centers).

StemExpress “took out the stem cells” and put them in a vial which it sold for $17,000, Daleiden told the court."
